Product Warranty
1. Treology Limited (the Supplier) warrants to its Customers for the Warranty Period that all Supplier manufactured products (excluding any third-party products) will be of merchantable quality, fit for the purpose notified by the Supplier to the Customer, conform with the specifications provided by the Supplier to the Customer and free from any default or defects (including any latent defect) in design, materials, and workmanship.
2. All claims by the Customer to the Supplier for breaches of the above warranty must be made by the Customer to the Supplier within the Warranty Period and the liability of the Supplier shall be limited at the Suppliers sole discretion to;
2.1 Replacement or repair of the products at the mutually convenient time (less the reasonable and proper costs incurred by the Supplier in retrieving, removing, collecting, and transporting the products to and from the Customers premises; or
2.2 Refund of the purchase price on return of the faulty goods to the Supplier or the Suppliers nominated agent.
2.3 The Supplier reserves the right to utilize new, reconditioned, refurbished, repaired or remanufactured products or parts in the warranty repair or replacement process or different products (where the originally installed products are no longer available or have been superseded). Such products will be comparable in function and performance to the originally installed products or parts, as determined by the Supplier in its sole discretion.
3. The liability of the Supplier in relation to third-party products supplied by the Supplier is limited to the warranty given by the manufacturer of those products and to the maximum extent permitted by law the Supplier gives no additional warranties in relation to those third-party products but will use reasonable endeavours to pass on to the Customer any warranty provided by the manufacturer of those products but shall not be bound nor liable for the such warranty.
4. The Supplier is not responsible for defects arising out of or in connection with;
4.1 Misuse, abuse, neglect, errors or other acts or omissions of or by the Customer or any person other than the Supplier.
4.2 Alterations (improper or otherwise) of the products by the Customer or any person other than the Supplier.
4.3 Exposure to water.
4.4 Failure to maintain the products.
4.5 Damage caused during delivery.
4.6 Damage caused during installation.
4.7 Failure by the Customer to follow Treology’s instructions or use the products for their intended use
4.8 Continued use of the products after a defect has become apparent or should have reasonably been apparent to the Customer.
4.9 Any circumstance of the Supplier’s control including expansion, contraction, cracking, bowing and distortion of the product as a result of exposure to heat, cold, temperature, moisture or otherwise.
4.10 Natural characteristics of the product including knots and splits.
4.11 Fair wear and tear, accident or Act of God.
5. The Warranty Period shall be;
5.1 Products used for residential purposes – 5 years from delivery.
5.2 Products used for commercial purposes – 3 years from delivery.
5.3 All warranties for products repaired or replaced during the warranty period will expire at the same time as the original warranty of the products that were replaced.
5.4 These warranties are supplemental to the Suppliers obligations as set out in the Suppliers Standard Terms and Conditions of Supply of products and to the extent that there is any inconsistency and shall override the same.
6. This warranty is only given to the Customer and not available to any subsequent owners.
